The New Brighton boy was taking out the trash with his foster mother, Librada Moran, when he vanished from a hallway of their Spring Creek development building at 130 Vandalia Ave. on Friday, Jan. 22, 2010 at about 9 p.m.
The foster mother was the last person known to see Patrick.
The boy was placed at the foster home when his mother, Jennifer Rodriguez, lost custody of Patrick and his two sisters on Dec. 26, 2009, after she was arrested on theft charges.
One week after Patrick’s disappearance, a Family Court judge jailed Rodriguez believing she was involved in the case. Rodriguez was released several days later after the city Administration for Children’s Services determined she didn’t have any connection with the disappearance.
Nine months after Patrick went missing, Rodriguez sued the city, Moran, the foster care agency and others in Brooklyn federal court, accusing them of negligence.
